The Town Clerk is elected
by the voters for a two-year term and serves as clerk of the Financial Town Meeting,
Probate Court, Town Council and as recorder of deeds. The Town Clerk's primary duties are
that of recording all town proceedings. The Town Clerk may appoint a deputy and when
appointed, shall have all the powers and perform all the duties which are incumbent on the
town clerk.
The Town Clerk is clerk of the Town Council and issues the
various licenses issued by the authority of the Town Council under its licensing powers.
The Town Clerk is custodian of the records and is responsible for maintaining such
records. Records and documents must be kept in a vault. Licenses issued by the Town Clerk
are: dog, kennel, amusement, peddlers, Sunday sales, victualling, liquor, yard sale and
art festival.
As recorder of deeds, the Town Clerk is responsible for the
safekeeping of all documents, papers, letters, maps, books, tapes and sound recordings.
The Town Clerk must maintain the records in a fireproof vault and all records must be
accessible to the public.
As clerk of the probate court, the Town Clerk must attend all
probate court sessions. The clerk must record the proceedings of the court, wills,
administrations, inventories, accounts, decrees, orders and all other writing which are
made, granted or decreed upon by the probate court. The clerk has custody and safekeeping
of the seal of the probate court and of all books and papers belonging to the probate
office.
The Town Clerk is the local registrar of vital records for the
purpose of recording births, deaths, and marriages. The clerk must require that
certificates be completed and filed in accordance with state regulations, transmit reports
to the State Department of Health by the 10th of the month, maintain such records, and
issue certified copies of such records.
As ex officio of the local board of canvassers, the Town Clerk
shall accept all voter registrations received in person or by mail. The board of
canvassers processes all voter registrations, transfer of registrations and provide to the
Secretary of State and Board of Elections a detailed computer disk on a monthly
basis.
BIRTH, DEATH & MARRIAGE RECORDS

Birth, Death, & Marriage records from approximately 1700 to
present day are indexed and stored in the Town Clerks Office. Pursuant to RI General Law the only Vital
Statistics available to the general public are death records over 50 years old, and birth
and marriage records over 100 years old. Certified
Vital records are available upon completion of a form by qualified persons. The cost for these records is $20.00 for the first
record, and $15.00 for each additional certified copy of the same record.
Birth certificates are available either as a full size legal document
($20.00) or as a laminated card ($21.00).
Marriage Licenses can be obtained from the Town Clerks Office
during normal business hours. The license is
valid for 90 days and the requirements are:
- The Brides
address must be a Scituate address;
- Birth Certificate
& Drivers License required for both parties;
- If not the first
marriage, certified proof of how previous marriage ended is required;
- Current fee set by
the State of Rhode Island is $24.00.
- Licenses must be
requested by 3:30 pm

The Town Clerk’s Office is a passport acceptance
facility. Normal processing
of a passport can take up to 6 weeks.
Processing can be expedited to 2 weeks for an additional fee of
$60.00.
Authorization of both parents is required for
children under 18 years old.
Passport Fees:
- Age
16 and Over – Total fee is $100.00 ($75.00 application fee payable to US Department
of State and $25.00 processing fee payable to the Town of Scituate)
- Under
age 16 – Total fee is $85.00 ($60.00 application fee payable to US Department of
State and $25.00 processing fee payable to the Town of Scituate)
The application fee must be paid by check or
money order. The processing fee can be paid by cash or check.
Required Documents:
DOG LICENSES
Dogs are required to be registered every April. A valid rabies certificate is required at the time
of registration. Scituate residents are
entitled to register no more than 2 dogs per residence.
The fee is $6.00 per dog. Licenses
may be obtained at the Town Clerks office during normal business hours. Traditionally, each April the Town holds a rabies
clinic where dogs & cats can receive their rabies shot at reduced rates. Licenses for dogs may also be obtained at the

YARD
SALES
Pursuant to the Scituate Code of Ordinance a yard sale may be
held for the sale of typically second-hand personal, household and/or garden property. Any town resident desiring to hold such a sale on
their property must apply to the Town Clerk for a yard sale license. The license fee is $5.00. Each resident is allowed to hold 2 yard sales a
year on their property.
Hunting,
Fishing, & Combination Licenses
Fishing & Hunting licenses for residents, non-residents
& tourists are available at the Town Clerks Office. All licenses other than Tourist three-day licenses
are valid from February to February each year.
All fees and
qualifications are mandated by RI General Law.
Please bring your drivers license and, if applying for
a hunting license, bring one of the following: a previous Rhode Island hunting license, a
hunter safety course certificate, an active military I.D. card; any honorably discharged
veteran may present discharge or DD214 papers.
TRADE NAME
Pursuant to RI General Law all
businesses in town shall register their trade name in the office of the Town Clerk and pay
a one-time fee of $10.00. A Certificate of
Trade Name will be issued to you.

MEETINGS
Notice of all meetings shall be
posted at least 48 hours before the meeting date. This
notice shall include the date and time posted; the date, time, and place of meeting; and a
statement specifying the nature of the business to be discussed. Town meetings are posted at Town Hall, on the Town
Website, & various other locations.
